Capella Awarded 27th Patent for Optical Routing Technology & Control

Thursday, February 21, 2008

Company Hires Leading Law Firm to Protect Capella's 27 Technology Patents

San Jose, CA -- Capella Intelligent Subsystems, Inc., the leading provider of subsystems for use in reconfigurable optical add/drop multiplexer (ROADM) applications, today announced that the United States' Patent Office has granted the company its 27th patent associated with Capella's WavePath® product family.

The company also announced today that it has retained leading global intellectual property law firm, Kirkland & Ellis LLP, to represent it with respect to the company's patented proprietary position in the marketplace.

In addition to the 27 issued patents, Capella has over thirty pending patent applications. Over the past six years, Capella has filed nearly one patent application per month in key areas of optical switching and management for communications.

"Capella is a technology leader in defining what has become to be known as Wavelength Selective Switch (WSS) subsystems for telecommunications applications," said Larry Schwerin, president and chief executive officer of Capella. "Many of our patents, such as US patents 6,879,750 and RE39,397, cover the basic architecture of the WSS."

Among other things, the patents grant Capella protection for any optical switching device that consists of: 1) one or more input ports (optical fibers) each containing multiple wavelengths of light; 2) a device for separating each wavelength from one another; 3) an array of beam deflecting elements that independently redirect each wavelength to a desired output port; and 4) one or more output ports each capable of carrying multiple wavelengths of light. Additional patent protection has also been granted for a WSS whose beam deflecting elements are controlled by a closed loop control/servo system.

Schwerin added, "Our intellectual property is a key company asset that we will vigorously safeguard for the benefit of our customers and shareholders. Capella has made an enormous investment to bring value to our customers through our technical and product innovations. Having the assistance of Kirkland & Ellis supports our ability to commercialize our optical wavelength management modules."

Capella will be exhibiting its advanced capabilities at OFC/NFOFC in San Diego on Feb 26 - 28, 2008.
