SureFire Sues PentagonLight for Patent Infringement and False Advertising
Tuesday, April 29, 2008
Fountain Valley, CA -- SureFire, LLC today announced that it has filed a lawsuit against PentagonLight for patent infringement and false advertising. The suit was filed in the United States District Court for the Eastern District of Texas.
"We filed this case for two simple reasons. SureFire's property is being knowingly and unfairly exploited, and consumers are being misled to their detriment and ours," said Dr. John Matthews, SureFire's founder and president. "SureFire is one of the world's leading creators of intellectual property related to flashlights and other illumination tools. Everything we do is based on the principle that intellectual property is one of our core assets and represents the work product of hundreds of American workers and millions of dollars of investment."
SureFire's suit alleges that PentagonLight willfully infringed and continues to infringe upon SureFire's U.S. Patent No. RE 40,125 relating to SureFire's patented lockout tailcap switch, a key component in many SureFire products. The false advertising claim alleges that PentagonLight has made false statements in its promotional materials indicating, among other things, that its flashlights are "Made in USA."
"When someone takes our intellectual property without permission we have no option but to protect it through every available means. We are also increasingly concerned that consumers are being misled by false claims. Law enforcement and military personnel often depend on their flashlights in life or death situations. These customers care about where that equipment is made and how it performs," said Matthews. "We built the SureFire brand on performance, technology, and integrity; those factors literally define our business philosophy and competitive advantage."
