i2Telecom Issued U.S. Patent #7,460,480 for Dynamically Adapting Transmission Rate of Packets in Real-Time VoIP Communications to Available Bandwidth

Atlanta, GA -- i2Telecom International, Inc., a leading developer of award-winning patented and innovative high-quality mobile applications and services, today announced that it has received U.S. Patent #7,460,480 from the U.S. Patent and Trademark Office ("USPTO") involving its claims for "Dynamically Adapting the Transmission Rate of Packets in Real-Time VoIP Communications to the Available Bandwidth" ("DMTR") technology. The Company believes that it is the most valuable patent it has been awarded to date, exceeding in value the patent that i2Telecom previously sold for $6.5 million.
DMTR Technology in use Worldwide
i2Telecom believes the DMTR technology is currently being used by a number of original equipment manufacturers, "OEMs" that deploy softphones, microgateway devices, gateways, routers or switches along with a number of carriers that use the technology to improve the quality and eliminate degradation issues when transmitting voice packets over the Internet.
Paul Arena, Chairman and Chief Executive Officer of i2Telecom International, Inc., said, "The DMTR technology patent is a foundational patent and a strategic component of our intellectual property. We believe that this patent has substantially more value than the patent we were granted earlier this year for our VoiceStick technology, which we sold for $6.5 million. We plan to aggressively pursue a licensing strategy, or monetization through the sale of the patent or a combination thereof."
He continued, "This is the second patent we have secured this year and we believe that our strategy of continuing to strengthen our intellectual property portfolio around our operations will create significant value and upside for our shareholders in the future.
"This recent patent is further validation and credibility of the outstanding efforts of everyone internally who developed the technology. Our innovative team has to date produced 2 patents, acquired 2 patent licenses and has 17 more patent applications pending."
First to File Patent on DMTR Technology
i2Telecom was the first to file a patent application on DMTR several years ago. Additionally, i2Telecom is seeking patent protection in several other countries throughout the world.
Telecom Patent Infringers Pay Settlements
Telecom companies have recently paid significant amounts of money to settle litigation brought in connection with patent infringement. Under the terms of the settlement and license agreements (see below), C2 Communications Technologies, INC., ("C2") granted each company a non-exclusive, perpetual, worldwide, fully paid up, royalty free license under any of C2's present patents and patent applications, including the VoIP Patent, to make, use, sell or otherwise dispose of any goods and services based on such patents in exchange for settlements in the amount of $17,625,000 in the aggregate paid to C2.
While the DMTR Patent #7,460,480 issued to i2Telecom is different, there are some similarities. In the case of illustrating value toward the substantiation of what a foundational Internet telephony patent is worth, the above sum was paid from only a handful of possible infringers and the patent ownership was maintained intact.
Recently, an order dismissing a lawsuit was signed and entered on October 2, 2008 with C2 which entered into settlement and license agreements with six telecommunications carriers with respect to its intellectual property for Patent #6,243,373, entitled "Method and Apparatus for Implementing a Computer Network Internet Telephone System, (the "VoIP Patent").
In February 2008, C2 entered into agreements with AT&T, Inc. ("AT&T") and Verizon Communications, Inc. ("Verizon"), and in May 2008, C2 entered into an agreement with Sprint Communications Co. L.P. ("Sprint"). In September 2008, C2 entered into an agreement with Qwest Communications International, Inc., Global Crossing Limited and Level 3 Communications, Inc. This agreement also included Sonus Networks, Inc.
The patent covers i2Telecom's DMTR technology. Some of the characteristics of the DMTR technology described in the allowed patent include:
- A method for adapting the transmission rate of media packets between endpoints in a Voice over Internet Protocol "VoIP" communication comprising: Determining a starting bandwidth measure at a starting point;
- Selecting a starting CODEC at the starting endpoint based on the starting bandwidth measure;
- Determining an ending bandwidth measure at the ending endpoint;
- Selecting an ending CODEC at the ending endpoint based on the ending bandwidth measure;
- Comprising a data rate equal to the lower of the starting CODEC nominal rate and the ending CODEC nominal rate;
- Obtaining a packet loss ratio of a media packet stream between the starting endpoint and the ending endpoint;
- Determining whether the packet loss ratio exceeds a maximum packet loss ratio associated with the current CODEC;
- When the packet loss ratio exceeds the maximum packet loss ratio, determining a nominal in-use data rate of the current CODEC;
- When the current frames per packet measure is greater than or equal to the maximum frames per packet measure, determining whether a substitute CODEC having a substitute nominal data rate that is lower than the in-use nominal data rate is available at the starting and ending endpoints;
- The method of ending a starting probe packet from the starting endpoint to a network device; echoing the starting probe packet from the network device to the starting endpoint;
- Determining the bandwidth of the path from the starting endpoint to the network device;
- The method for adapting the transmission rate of media packets between endpoints in a VoIP communication, wherein; The network device is selected from a STUN server, a SIP server, an endpoint, and an echo server;
- The method for adapting the transmission rate of media packets between endpoints in a VoIP communication, wherein: Selecting the starting CODEC at the starting endpoint comprises; Associating the starting CODEC with a bandwidth range;
- Determining whether the starting bandwidth measure is within the bandwidth range; and
- If the starting bandwidth measure is within the bandwidth range, then selecting the starting CODEC.
A codec is a device or program capable of encoding and/or decoding a digital data stream or signal. The word codec may be a combination of any of the following: 'compressor-decompressor', 'coder-decoder', or 'compression/decompression algorithm.

"The recent issuance of a Patent by the USPTO involving our DMTR technology bolsters the Company's ability to protect and enforce its intellectual property rights, which we believe may have been violated by dozens of companies in the telecommunications and electronic communications device industries.
