Patent Calls Investigation Concludes 19 Tech Companies Including Dell and Intel Are Not Infringing Wi-LAN Bluetooth Patent

Wednesday, April 14, 2010

Independent Patent Research Firm Releases Its Analyst Report

Austin, TX -- Patent Calls, Inc., an independent research firm that provides unbiased, comprehensive patent reports and analysis, has conducted an independent analyst report on US Patent 5,515,369 (‘369) – the patent that 19 tech companies are allegedly infringing according to a complaint filed by Wi-LAN on April 7, 2010.

Among the companies Wi-LAN is accusing of patent infringement are technology giants Dell, Texas Instruments, Motorola, Intel, Apple and Sony. Wi-LAN claims the companies are infringing their ‘369 patent because they use “products with wireless capability compliant with the Bluetooth standards.”

Despite Claims, Patent Calls Disagrees

However, despite Wi-LAN’s claims, an in-depth analysis of patent ‘369 and of the Bluetooth specifications by Patent Calls finds otherwise. Patent Calls' analysis concludes that compatibility with the Bluetooth standard does not require infringement of Wi-LAN’s ‘369 patent, and that the Bluetooth standard is different from the claimed elements of the patent.

“It is simply not true that complying with the Bluetooth standard implies infringement of the Wi-LAN patent. A quick review of the Bluetooth specification should make that very clear to anyone, except perhaps Wi-LAN,” said Dr. Jose Melendez, Senior Technology Analyst for Patent Calls, Inc.

“It seems apparent from the complaint in this case that Wi-LAN is attempting to hang its hat on the Bluetooth specification entirely, and has likely made no reasonable efforts to actually observe or measure the frequency behavior of the defendants’ products in question.”

Only a judge and jury can decide if the defendants in the case are infringing, however, considering Patent Calls analysis, it may be an uphill battle for Wi-LAN.

In conjunction with the ‘369 patent report, Patent Calls also released a feature article on the case, which is posted on the News section of the company’s website at http://www.patentcalls.com/news.html.
