Cook Vows to Protect Its Stent Valve Intellectual Property Portfolio

Bloomington, IN -- Cook today announced that the first instance German Federal Patent Court found Claim 1 of the German Patent corresponding to European Patent 1 255 510 B3, entitled “Stent Valves” invalid.

“We are disappointed in the first instance's decision,” Cynthia Kretz, general counsel of Cook Incorporated, said immediately after the German decision. “We appreciate the time that the German first instance Court provided in hearing our reasons for why our claims are valid, but we respectfully disagree with the Court’s decision.”

Cook legal counsel and senior executive staff stressed that the company is committed to establishing and defending its patent rights in this growing field of medical technology on a global basis.

“Protecting Cook's extensive intellectual property concerning transcatheter valve technology is a priority to the company's mission, and we will evaluate all options,” said Pete Yonkman, executive vice president of sales and marketing for Cook Medical.
