ThyssenKrupp Elevator Wins Patent Infringement Case

Swiss Inventio AG patents found invalid

Frost Brown Todd’s David Schmit, with a team consisting of William Morriss, Ann Schoen, Kelly Kuhl, Amy Carrico, and Christine Schmit, won a major patent case for ThyssenKrupp Elevator Corporation. On February 28, following a week-long trial in the infringement case against ThyssenKrupp filed by Inventio AG in 2008, a Delaware federal jury found that two Inventio patents for an elevator modernization system were invalid. Inventio was seeking damages for three jobs that had been completed, as well as for any future jobs. The jury took three and a half hours to come to its decision.

This is the second lawsuit Inventio AG (a Swiss sister company of Schindler Elevator Corporation) has filed against ThyssenKrupp. In December 2013, Inventio dropped the previously-filed case related to elevators at 1 World Trade Center in New York after Inventio’s patent was found invalid.
